Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) forms part of the Terms of Service of Minexnodes (“Minexnodes”, “we”, “us”, or “our”). This AUP applies to all services, including but not limited to game server hosting, VPS services, control panels, API access, backups, and any related infrastructure or features made available by Minexnodes.

By using the services, you agree to comply with this AUP. Violations of this AUP may result in warnings, restrictions, suspension, termination, deletion of data in accordance with the Terms of Service, refusal of future orders, or other measures reasonably necessary to protect Minexnodes, its infrastructure, other clients, or third parties.

  1. Lawful Use

1.1 You may use the services only in accordance with the Terms of Service, this AUP, applicable law, and any technical or operational documentation made available to you.

1.2 You are solely responsible for all content, software, data, and activities carried out through your services and for ensuring that such use complies with all applicable laws and third-party rights, including intellectual property, data protection, consumer, and criminal law.

1.3 The services may not be used for any unlawful purpose, including but not limited to:

a) the distribution, storage, or processing of illegal content;

b) copyright, trademark, or license infringement, including the use of pirated software, cracked games, or unauthorized server jars;

c) fraud, deception, impersonation, or other criminal activity; or

d) any activity that would reasonably expose Minexnodes to legal liability, sanctions, takedown demands, or regulatory action.

  1. Permitted Service Use

2.1 Game hosting services may be used to host legitimate game servers and to install and operate compatible mods, plugins, and related tools, provided that all such software is lawfully acquired, properly licensed, and used in accordance with the applicable EULAs, terms of use, and license conditions.

2.2 VPS services may be used for general-purpose hosting activities, including software, applications, websites, and related services, provided that such use complies with the Terms of Service, this AUP, applicable law, and the technical and resource limits of the selected plan.

2.3 In all cases, you may not use the services to store, process, distribute, or operate content, software, or data that is illegal, infringing, abusive, malicious, or otherwise prohibited under this AUP, regardless of whether the service is a game server, VPS, or other hosting product.

  1. Prohibited Activities

3.1 The following activities are strictly prohibited on all Minexnodes infrastructure:

a) conducting, facilitating, participating in, or attempting distributed denial of service (DDoS) attacks, denial-of-service attacks, stress-testing, or similar disruptive activity without our prior written authorization;

b) unauthorized port scanning, network probing, vulnerability scanning, enumeration, or similar reconnaissance activity targeting third-party systems or Minexnodes’ own infrastructure;

c) hosting, distributing, controlling, deploying, or facilitating malware, viruses, trojans, ransomware, botnets, crypting tools, loaders, malicious scripts, or any other harmful code or framework;

d) crypto-mining, blockchain mining, token generation, or other similar resource-intensive computational activity, whether for personal or commercial benefit;

e) hosting, processing, storing, or distributing pornographic or otherwise sexually explicit adult content, including content intended primarily for adult entertainment;

f) phishing, spoofing, credential harvesting, identity abuse, financial scams, or social engineering campaigns;

g) use of the services to evade enforcement, hide abusive activity, relay malicious traffic, or support unlawful third-party conduct; or

h) any other activity that Minexnodes reasonably determines to be abusive, harmful, deceptive, unlawful, or incompatible with the safe and reliable operation of the services.

3.2 Minexnodes reserves the right to determine, in its reasonable discretion, whether particular conduct or usage constitutes prohibited activity under this AUP.

3.3 Minexnodes may, without prior notice, take immediate technical or legal action where Minexnodes reasonably determines that a user’s conduct constitutes an imminent threat to the security, integrity, availability, or lawful operation of Minexnodes’ services, infrastructure, staff, clients, upstream providers, or third-party systems.

  1. Resource Usage and Fair Use

4.1 Each service plan includes defined resource allocations, which may include CPU, RAM, storage, storage I/O, bandwidth, backup features, and other technical limits as described in the relevant order confirmation or plan description.

4.2 You may not:

a) run processes in a manner that unreasonably degrades the stability, performance, or availability of the underlying node, host system, storage layer, or network;

b) deliberately overload, benchmark-spam, or stress the infrastructure through intentional misconfiguration, abusive scripts, loops, attack tools, or other disruptive methods; or

c) consistently consume significantly more CPU, RAM, storage I/O, bandwidth, or similar resources than is reasonably associated with your plan, except for short-term bursts tolerated by Minexnodes’ systems.

4.3 Where your usage negatively impacts node stability, performance, or other clients, Minexnodes may:

a) request that you reduce usage or modify your configuration;

b) apply technical limitations, throttling, caps, or rate limits;

c) recommend or require migration to a more suitable service plan; or

d) suspend or terminate the affected service where the issue is not remedied within a reasonable time or where immediate action is necessary.

  1. Game Server Software, Mods and Licensing

5.1 You are responsible for configuring, managing, and maintaining your game servers, including the installation and management of mods, plugins, custom content, server jars, and related software.

5.2 Minexnodes does not impose a contractual numeric limit on the number of mods or plugins you may use unless a specific product page, plan limit, or technical restriction expressly states otherwise. Any display limit, truncation, or interface limitation shown in a panel or user interface does not change your obligations under the Terms of Service or this AUP.

5.3 You may use only legitimate and properly licensed server software, binaries, jars, mods, plugins, and related content. The use of unauthorized, cracked, pirated, stolen, or otherwise unlawfully distributed software or assets is strictly prohibited.

5.4 You are solely responsible for ensuring that any software you upload, install, or run complies with all applicable EULAs, license conditions, and intellectual property rights for the relevant games, engines, frameworks, mods, and tools.

5.5 Unless you have purchased a managed service or support add-on, Minexnodes is responsible only for the hosting infrastructure and standard control panel functionality, and not for application-level or game-specific configuration, optimization, or debugging.

  1. Network and Security Rules

6.1 You may not attempt to bypass, disable, interfere with, or undermine any security controls, firewalls, rate limits, abuse controls, anti-DDoS systems, authentication systems, or protective mechanisms implemented by Minexnodes or its upstream providers.

6.2 The following activities are prohibited:

a) hosting or operating open proxies, open relays, open VPN nodes, or similar services intentionally configured to permit arbitrary unauthenticated third-party traffic where such use materially increases abuse risk;

b) attacking, probing, interfering with, or attempting unauthorized access to other servers, services, accounts, containers, VPS instances, nodes, or clients on Minexnodes’ infrastructure;

c) attempting to access the host node, hypervisor, container host, control plane, storage backend, or other infrastructure layers not expressly assigned to you; and

d) any deliberate attempt to degrade, disrupt, or compromise the security, confidentiality, or availability of Minexnodes’ infrastructure, upstream providers, or third-party networks.

6.3 Minexnodes may implement firewalls, monitoring, traffic filtering, automated abuse detection, and similar technical safeguards to protect the services and clients. You may not circumvent or attempt to circumvent such measures.

  1. Data, Backups and Deletion

7.1 You remain primarily responsible for creating and maintaining your own independent backups of all data, configurations, and content outside of Minexnodes’ infrastructure.

7.2 Minexnodes may maintain node-level backup or snapshot systems for operational resilience, disaster recovery, or security response purposes. Such backups or snapshots do not replace your obligation to maintain independent backups.

7.3 Where technically feasible, Minexnodes may offer a paid Node Backup Restore Service on a best-effort basis. Availability of snapshots, completeness of data, recovery time, and restoration outcome are not guaranteed.

7.4 Minexnodes is not liable for data loss resulting from your failure to maintain adequate independent backups, lawful deletion under the Terms of Service or this AUP, or the inherent limitations of snapshot-based recovery, except to the extent caused directly and solely by Minexnodes’ gross negligence or wilful misconduct where such limitation is not prohibited by law.

  1. Abuse Handling and Enforcement

8.1 Where Minexnodes identifies or reasonably suspects a violation of this AUP, Minexnodes may, depending on the severity and urgency of the situation:

a) issue a warning and require corrective action within a specified timeframe;

b) restrict, disable, or throttle specific services, functions, ports, or access;

c) suspend the affected service or account;

d) terminate the affected service or account; and/or

e) block future orders, including orders associated with the same payment method, account details, identity markers, or related identifiers, where abuse, fraud, or payment risk is involved.

8.2 Minexnodes will generally attempt to provide a warning and a reasonable opportunity to cure before suspension or termination, except where:

a) the violation creates an immediate or significant risk to infrastructure, clients, staff, or third parties;

b) the activity appears clearly illegal, malicious, fraudulent, or linked to serious abuse; or

c) Minexnodes is legally required or technically compelled to act without prior notice.

8.3 In cases of serious abuse, repeated violations, failure to cooperate, or high-risk conduct, Minexnodes may permanently deny access to services, reject future orders, preserve logs or records where legally required, and report the matter to competent authorities or affected third parties where permitted or required by applicable law.

  1. Minors

9.1 Minors may use the services only within the responsibility and authorization framework set out in the Terms of Service.

9.2 Where a minor uses the services, the parent, legal guardian, or other authorized representative remains fully responsible for payments, supervision, compliance with the Terms of Service, and compliance with this AUP.

  1. Reporting Violations

10.1 Suspected violations of this AUP, including illegal content, infringement claims, abuse reports, fraud reports, or security complaints, must be reported through Minexnodes’ designated support or abuse contact channels.

10.2 Minexnodes may request information reasonably necessary to investigate a report and may take action based on the information available, applicable law, and the need to protect the services and third parties.
